GENERAL TERMS & CONDITIONS

Experience Designers (ED) Korea (herein referred to as “the Company”) is a licensed travel agent for incoming trips to Korea and a subsidiary company of ED Group Ltd. The Company reserves the right to change, remove, or modify the Terms any time at its discretion.

1. Contract

The booking conditions apply to the person making the booking and all other persons on whose behalf the booking is made. The person making the booking must be authorised to make the booking on behalf of the members of the party. The person making the booking must also provide a copy of these terms and conditions to the other members of the party. Upon the verbal or written registration (i.e. the booking from the customer) in which the Company confirms and accepts, a contract exists between the customer and the Company. The contract becomes legally binding from the date on which the Company has confirmed and accepted the customer in writing with an invoice. Through the booking, the customer is deemed to have read and accepted the terms and conditions of the Company.

2. Object of the agreement

The Company assumes responsibility only for providing the requested services as described in the reservation details. The third party suppliers providing transportation, sightseeing arrangements, tours, excursions and accommodations, etc. are independent third parties and are not agents, affiliates, representatives or employees of the Company (see Section 12). Service extensions can be considered upon consultation with the Company but any incurred extra costs will be borne solely by the customer.

3. Pricing

All prices are quoted in EU Euros (EUR) or U.S. Dollars (USD) unless otherwise noted and are made using the exchange rates valid during the posted date of the tour. In the case of any major differences in the currency exchange rate, the Company reserves the right to increase the price of the tour up the 45 days in advance at which time the customer is required to pay the difference or request a full refund. The effective prices for the offered tour packages can be drawn from the current advertisements from the organiser. Child reductions will be calculated deepening the age of the child and for hotel rooms depending on the number of full paying adults with whom the child will share the room. Prices are subject to change at any time, and the Company reserves the right to make adjustments if a particular price was incorrectly stated. In such an event, if possible, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation without penalty.

Prices do not include: airline baggage or seat assignment fees, passport and visa fees, gratuities, meals and beverages (unless specifically noted), resort fees, hotel energy surcharges, parking and valet fees, insurance, telephone calls, additional bedding charges, laundry service, and other miscellaneous charges of a personal nature are not included except where specifically noted.

4. Surcharges

The Company reserves the right to increase tour cost to take into account any of the following: government action, currency exchange rates, transportation costs (including the cost of fuel), and local taxes.

5. Reservations and Payment

Reservations will not be secured until all balances are paid in full. A deposit is required within one week of booking and receipt of the invoice. Final payment should be made in full by international bank transfer at least 7 days prior to the experience or 60 days prior to a travel booked with The Company, unless other arrangements are made with the Company. The customer can request to make an initial deposit payment and finish by instalments. The Company is not responsible for any banking fees or penalties, fare increases, or other fees due to late payment. Payment by PayPal is an available option with a 3.9% surcharge.

If your booking or account shows any signs of fraud, abuse or suspicious activity, the Company reserves the right to cancel any bookings associated with your name, email address or account. If you have taken part in any type of fraudulent activity, the Company may take necessary legal action and you may be liable for any monetary damages.

International Bank Transfer: payments should be sent to the mentioned bank account during the exchange with The Company.

6. Cancellations and Refunds

The cancellation policy is as follows:

If the cancellation of the travel notice is received before

  • 30 days: No charge (You will receive a full refund.)

  • 29-7 days: 30% of total charge (70% refund)

  • 06-01 days: 100% of total charge (0% refund)

If the cancellation of the Experience notice is received before

  • 7 days: No charge (You will receive a full refund.)

  • 3-6 days: 30% of total charge (70% refund)

  • less than 3 days: 100% of total charge (0% refund)

Small or large group tours may be subject to different cancellation policies. The customer is not entitled to a refund in the event of a later start or an early departure from the activity.

Extra costs incurred due to a later start, an early departure, or the postponement of an activity, are to be paid by the customer.

7. Changes by the Client

Any changes to the original booking must be requested and confirmed in writing. All changes made will result in reservations being re-priced to reflect the rate at the time of the change and availability cannot be guaranteed. Any changes to the itinerary after the commencement of travel will require direct payment to the Company of additional fees due to price differences, fuel charges, ticket re-issuance fees, or any other extra fees incurred due to last minute changes.

8. Cancellation or Change of Contract by the ORGANISER

The Company reserves the right to cancel the program on short notice if participants cause the fulfilment of a contract to be endangered or made impossible by their behaviour, their omissions or other actions. If a program or parts of a program cannot be carried out due to Acts of God, safety concerns by the organiser, official regulations, strikes or uncertain weather and nature conditions, the organiser reserves the right to cancel or cut short the activities on short notice. Please note that a danger-free completion of the activity is in everyone’s interest. All decisions made by the activity leaders are final. The Company expressly reserves the right to modify the program and will strive for an equivalent service replacement.

9. Conditions of Participation, Obligations of the Participant

Good health is necessary in order to take part in all activities. The participants are obligated to inform the organiser of any possible health problems or restrictions at the time of booking. Customers who require special accommodations must disclose their needs at the time of booking. Available accommodation standards cannot be guaranteed. The Company takes no liability for any failure of provisions by any third party vendors.

Under no circumstances may participants take part in the activities while under the influence of alcohol, drugs, psychiatric drugs or any similar substances. The participants are obliged to fulfil the conditions of participation and agree to strictly follow the instructions of the organiser, the guides, activity leader, and assistants. If the Conditions of Participation are not fulfilled or if instructions are disregarded, the organiser reserves the right to prohibit participation.

10. Local Laws

All participants in tours operated by the Company are responsible for compliance with local laws and regulations of the country visited. Failure to do so will void the contract between the customer and the Company and relieve the Company of all obligations previously stated.

11. Insurance

The customer is held wholly responsible for arranging their own insurance and is obliged to ensure that they have sufficient health and accident insurance coverage. Customers should also ensure there are no exclusion clauses limiting protection during any activities that may take place during their tour.

12. Passport and Visas

It is the sole responsibility of the customer to ensure all foreign entry requirements are met and that they obtain all necessary travel documentation prior to departure. Requirements for international travel are subject to change and the customer is responsible for ensuring he/she has a valid passport at the time of travelling and that they hold all necessary visas or permits and allow adequate time to obtain them. Children are required to hold individual passports. Names provided to the Company must be a direct match to the photo identification that will be used during the time of travel. The customer is responsible for any fees or expenses, including refusal of travel, incurred due to providing an incorrect name.

11. Complaints by customer

Complaints should be addressed to the Company by phone during the event and then in written form. If the source of a complaint is an accommodation, the complaint should be introduced as soon as possible so that the Company can resolve the issue during the stay of the customer.

In any case, a complaint introduced after the return of the customer to his home country cannot be taken into consideration. The Company cannot be held responsible for the faults committed by third parties such as hotels, bus companies, guides, restaurants, ferries, car rental or yachting companies nor air carriers. However, the Company will do all possible in its power to solve the source of the complaint as long as they have been brought forth in due time.

12. Liability

Neither the Company, nor any of its representatives are liable or responsible for any loss, injury, damage to person, property, or otherwise in connection with any third party accommodations, transportation, baggage/personal property or other services resulting directly or indirectly from any extraordinary circumstances, including but not limited to neglect of the activity leader or third party, acts of God, natural occurrences, breakdown of machinery, acts of governments, hostilities, civil disturbances, thefts, medical quarantines/epidemics, customs regulations, delays, cancellations or changes in itinerary, routing or schedules from any cause beyond the control of the Company, or from any loss or damage resulting from insufficient or improperly issued passports, visas or other documents. Damage claims against the organiser or the assistants are excluded, as far as the damage was not caused by negligence or intentionally.

13. Privacy

All of the personal information given to the Company by its customers will be used solely for the purpose of the service(s) to be booked. This information will not be communicated to any other third parties save for those required to provide the services booked.

14. Jurisdiction

In case of disputes between the Company and its customers, the matter will be submitted to the Supreme Court of South Korea who has the sole power to conclude. Whatever conclusion is reached by the Supreme Court of South Korea, the decision will be final.
